NEWSLETTER 09-2015: INHERITANCE LAW REFORM 2015 – PART I
The majority of the currently valid inheritance law regulations are still based on the General Civil Code (ABGB for short), which has been essentially unchanged since 1811. However, two drastic reforms are now imminent, which are intended to modernize inheritance law and adapt it to the requirements of the 21st century. In some cases only superficial changes are made, but in others there are also drastic changes, which in any case – not least because everyone has to deal with inheritance law issues at some point – make it necessary to deal with these topics intensively.
It starts with the European Inheritance Regulation, which was passed in 2012 and will now come into force on August 17, 2015. Subsequently, the Inheritance Law Amendment Act 2015 passed by the National Council this year will (for the most part) come into force on January 1, 2017.
Due to the scope of the changes, we will inform you about the upcoming changes in two parts. In part I below you will find information on the European Inheritance Regulation and the changes in the area of compulsory portion law from January 1, 2017 in connection with the Inheritance Law Amendment Act 2015.
In Part II, which will follow on August 21, 2015, you will find information on all further details of the Inheritance Law Amendment Act 2015, which will also come into force from January 1, 2017.
