NEWSLETTER 01-2021: STENTER DISCLOSURE OBLIGATIONS OF TENANT COMPANIES
The Supreme Court (OGH) recently took a position on the effects of failure to report changes within the ownership structure of legal entities that are tenants of business premises. In its decision, it tightened the bodies’ information obligations and expanded the landlord’s claims for damages in the event of a violation of this.
Through a recent decision (4 Ob 128/20g of October 20, 2020), the Supreme Court (OGH) has revised the disclosure obligations of legal entities their status as tenants of business premises vis-à-vis their landlords in the event of changes in their ownership structure. A violation of the relevant reporting obligations will – due to the now clarifying decision of the OGH – probably lead to significantly more comprehensive financial compensation claims from the landlord than previously known.
