In our current newsletter we inform you about the current COVID-19 case law on business premises rental as well as the current legal provisions regarding reclaims of subsidies to COFAG as a result of a breach of the obligation to mitigate damages.

 

According to the Supreme Court’s ruling, no rent payments are to be made for existing properties that are temporarily unusable due to an official ban on entry during the COVID-19 pandemic. In this context, the question then arises as to how this case law affects the affected COFAG funding and whether and how it should be repaid.
