The administrative criminal cumulation principle repeatedly becomes a spectre for managing directors, board members and other managers. If the authority punishes several similar violations (e.g. salary records of several employees are not kept available), a separate fine will be imposed for each violation and for each affected employee.
However, the ECJ has now rejected this cumulation principle in one case. The following newsletter is intended to provide an overview of the current legal situation and the effects of this decision.
