NEWSLETTER 07-2015: INTENSIFICATION OF CYBERCRIME ACT
In February 2013, the then Minister of Justice Univ. Prof. Dr. Beatrix Karl set up a working group with the aim of submitting a report on what changes to the Criminal Code are considered necessary so that the 1975 Criminal Code can be reformed and modernized. The “Criminal Code 2015” project was initiated by the current Minister of Justice, Univ. Prof. Dr. Wolfgang Brandstetter continued. The deadline for reviewing the ministerial draft ended on April 24, 2015. The changes are scheduled to come into force on January 1, 2016.
The Criminal Law Amendment Act 2015 is intended to take technical progress into account, develop specific provisions in the area of cyber crime and introduce a new offense for spying on data from a non-cash means of payment. It is also important to counteract the undesirable new social phenomenon of “cyber bullying” with the Criminal Law Amendment Act 2015.
