NEWSLETTER 07-2017: CLIENT LIABILITY IN THE CONSTRUCTION INDUSTRY – HFU COMPLETE LIST
A major danger in the construction industry is the liability of the client for the contribution debts of a contractor (subcontractor).
This client liability does not apply if the commissioned company is included in the overall list of companies exempt from liability (HFU overall list) at the time the wages are paid.
Although client liability for subcontractors in the construction industry has been in effect since September 1, 2009, the details of this regulation continue to cause difficulties for many companies.
Client liability enables health insurance providers to claim a contractor’s contribution debts from their client under certain conditions for companies active in the construction sector.
All companies that pass on an order for the provision of construction services or the cleaning of buildings in whole or in part to another company are affected by client liability .
The client’s liability does not apply if the commissioned company is included in the comprehensive list of liability-exempt companies (HFU-comprehensive list) at the time the wages are paid.
