NEWSLETTER 08-2017: BASIC DATA PROTECTION REGULATION (EU GDPR) – IMPLICATIONS FOR COMPANIES
The General Data Protection Regulation (GDPR) comes into force on May 25, 2018 and, due to its regulatory nature, is directly applicable in the individual member states of the European Union.
The new legal situation presents companies with comprehensive and sometimes complex challenges. Given the severe administrative penalties that can be imposed if the provisions of this regulation are violated, companies should familiarize themselves with the EU GDPR as soon as possible.
The rapidly advancing technological development and the increased data exchange associated with globalization made it necessary to harmonize the existing regulations to protect the fundamental rights and freedoms of natural persons in data processing.
Against this background, the “Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data, on the free movement of such data and repealing Directive 95/46/EC” (long title) was adopted in April 2016.
