Inheritance law – request for information from the person entitled to a compulsory share

In the decision 2 Ob 85/18s of the OGH of October 30, 2018, the Supreme Court had to deal in particular with detailed questions of the right to information of a person entitled to a compulsory share against a private foundation and several people entitled to a compulsory share. In the decision discussion at hand, the exciting details of this decision, which was made under the old legal situation before the ErbRÄG 2015, are examined and analyzed in more detail.
