Legal framework for private equity funds

Private equity funds are locusts? Not even close! Private equity and venture capital have become an integral part of business life. Targeted legal frameworks for private equity are few and far between in Austria. The medium-sized business financing company is a discontinued model and the newly planned investment company is likely to be anything but practical.
This work deals with the legal and business framework for private equity funds (especially) in Austria. National and international fund vehicles are presented and their advantages and disadvantages (also from a tax perspective) are shown. The relationship between private equity funds, investors, management and investment companies is legally prepared based on AVCO’s investor relations guidelines. The aim of this work is to provide a practical “handbook” that particularly highlights fundraising, the constitution of the fund, the acquisition of investments, the exit, the liquidation of the fund and the relationship between the parties involved.
