The early dismissal of the foundation board

As numerous cases, some of which are pending in court, show, the early dismissal of the foundation board is an issue of enormous and ever-increasing practical relevance. In consulting practice, it is noticeable that there are numerous misunderstandings in connection with the legal basis and the practical implementation or combating of premature dismissal, both on the part of those potentially entitled to dismissal and on the part of the foundation board members who may be affected by the dismissal. With this article we want, on the one hand, to present a well-founded legal overview of these subject areas and, on the other hand, to advocate in detail areas for an interpretation of currently controversial legal questions that can also be applied in practice.
